Terms of Use

Please read these Terms of Use ("Terms") carefully before using FormVillage. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. About us

FormVillage ("the Service") is operated by GoBurley ("we", "us", "our"), a web design and IT services business based in the South West of England. Contact: george@goburley.com.

2. Eligibility

You must be at least 18 years old to create a FormVillage account. By registering, you confirm that you are 18 or over and that the information you provide is accurate and complete. You are responsible for maintaining the security of your account credentials.

3. The Service

FormVillage is an online platform that allows event organisers ("Users") to create booking forms for community events, charities, clubs, and similar activities. The Service enables:

  • Creation and publication of booking forms
  • Collection of attendee registrations and contact information
  • Administration of bookings via a secure dashboard
  • Export of booking data

FormVillage does not process attendee payments. Payment is handled directly between organisers and attendees using the organiser's chosen payment method. We are not a party to any financial transaction between you and your attendees.

4. Credits and subscriptions

4.1 Pay-as-you-go credits

Publishing a form requires one credit. Credits are purchased in packs and deducted at the point of publishing. Credits never expire. Credits are non-refundable once purchased, except where required by applicable consumer law.

4.2 Subscription plans

Subscription plans grant a set number of form publications per calendar month. Unused monthly allowances do not roll over. Subscriptions renew automatically until cancelled. You may cancel at any time from your Account page. Cancellation takes effect at the end of the current billing period; no partial refunds are given for unused time.

4.3 Credit add-ons

Subscribers who have exhausted their monthly allowance may purchase additional PAYG credits to publish further forms within the same month. These credits are subject to the same non-refundable terms.

4.4 Pricing changes

We reserve the right to change credit and subscription prices. Existing subscribers will be given at least 30 days' notice before any price increase takes effect on their plan.

5. Your responsibilities

By using FormVillage, you agree that:

  • You will only create forms for legitimate events and will not use the Service for fraudulent, deceptive, or illegal purposes.
  • You will not publish false, misleading, or defamatory content on your forms.
  • You are solely responsible for all content on your forms, including event descriptions, terms, and payment instructions.
  • You will comply with all applicable data protection laws (including UK GDPR) when collecting and using attendee data.
  • You will not use the Service to collect sensitive personal data (such as financial account numbers, government ID numbers, or medical records) beyond what is reasonably necessary for your event.
  • You will not attempt to circumvent, hack, or abuse the Service or its infrastructure.
  • You will not use automated tools to scrape, crawl, or overload the Service.
  • You accept full responsibility for the accuracy of payment instructions provided on your forms and for any payment disputes with your attendees.

6. Data and attendee responsibility

You are the data controller for any personal data collected about your attendees through FormVillage forms. We act as a data processor on your behalf. You are responsible for:

  • Having a lawful basis to collect attendee data
  • Informing attendees about how their data will be used
  • Complying with any data subject requests from your attendees
  • Exporting any data you need to retain before the automatic deletion deadline (44 days from publication)

We accept no liability for data lost due to the automatic deletion schedule. You are responsible for exporting your data before it is deleted.

7. Intellectual property

The FormVillage platform, including its design, code, and branding, is the intellectual property of GoBurley. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purposes.

You retain ownership of all content you create on the platform (form titles, descriptions, event details). By using the Service, you grant us a limited licence to store and display that content solely for the purpose of operating the Service.

8. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

  • The Service will be uninterrupted, error-free, or completely secure
  • Any errors will be corrected
  • The Service will meet your specific requirements

We are a small team and while we aim for high availability, we cannot guarantee it. Scheduled or emergency maintenance may occasionally result in downtime.

9. Limitation of liability

To the maximum extent permitted by applicable law:

  • GoBurley shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • GoBurley shall not be liable for any loss of profits, loss of data, loss of bookings, or financial loss arising from the Service being unavailable or malfunctioning.
  • GoBurley is not liable for any disputes between event organisers and their attendees, including payment disputes, event cancellations, or failure to deliver an event.
  • GoBurley is not liable for the actions, omissions, or content of any event organiser using the platform.
  • Our total aggregate liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the total amount you have paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Indemnity

You agree to indemnify and hold GoBurley harmless from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or any dispute between you and your event attendees.

11. Suspension and termination

We reserve the right to suspend or terminate your account without notice if:

  • You breach these Terms
  • We have reason to believe your account is being used for fraudulent or illegal purposes
  • You engage in conduct that could damage FormVillage or other users

You may delete your account at any time from the Account page. Deletion is immediate and irreversible. Unused credits and subscription time are forfeited upon account deletion and are non-refundable.

We reserve the right to discontinue the Service at any time with reasonable notice.

12. Third-party services

FormVillage integrates with third-party services including Stripe (payments), Supabase (database), Resend (email), and Vercel (hosting). Your use of those services is subject to their respective terms of service. We are not responsible for their availability, pricing, or policies.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email and by updating the "Last updated" date above. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
